Data Protection Policy

(i) For the purpose of the Regulation ‘personal data’ means any information relating
to an identified or identifiable natural person (‘data subject’); an identifiable natural
person is one who can be identified, directly or indirectly, in particular by reference
to an identifier such as a name, an identification number, location data, an online
identifier or to one or more factors specific to the physical, physiological, genetic,
mental, economic, cultural or social identity of that natural person and ‘consent’ of
the data subject means any freely given, specific, informed and unambiguous
indication of the data subject's wishes by which he or she, by a statement or by a
clear affirmative action, signifies agreement to the processing of personal data
relating to him or her;
(ii) Your personal data relating to you is being collected from you and accordingly I
provide you with the following:-
(a) I am the controller of your personal data,
(b) My contact details are identified on this websie
c) I will hold and retain your personal data for a period of seven years from the date
of this letter,
(d) the purposes of the processing for which the personal data are intended as well
as the legal basis for the processing are set out in paragraph 10 (iii) of this letter;
(e) By signing this letter you agree to give your consent to the processing of your
personal data for one or more of the purposes set out in paragraph 20 (iii) of this
letter,
(f) processing is necessary for my compliance with the Bar Council rules of Direct
Public Access that I hold and retain records of all matters for a period of seven years,
(g) I have a legitimate interest in processing your personal data in that it is necessary
for me to comply with the Bar Council rules of Direct Public Access that I hold and
retain records of all matters for a period of seven years, that it is necessary for me
to hold and retain records of your matter in order to carry out the legal services I
provide to you, to deal with conflict checks, to deal with complaints, training of pupils,
legal proceedings or fee disputes, to keep anti money laundering records, and/or in
exercising a right to a lien,
(h) I will provide you with details of the recipients or categories of recipients of the
personal data including pupil barristers, courts and other tribunals to whom documents
are presented,
potential lay witnesses and expert witnesses, your friends or family, solicitors,
barristers, pupil barristers and other legal representatives, ombudsmen and
regulatory authorities, current past or prospective employers, education and
examining bodies, business associates, professional advisers and trade bodies.
(iii) The purposes for which your personal data is intended to be processed is to
enable me to provide legal services to you, to carry out the training of pupil
barristers, to carry out conflict-checking, for use in the defence of potential
complaints, for use in legal proceedings or fee disputes, to keep anti-money
laundering records, and/or in exercising a right to a lien.
I provide you with the following for the purpose of transparency:
(a) the period for which the personal data will be stored is seven years from the date
of this letter,
(b) you have the right to request from me access to and rectification or erasure of
personal data or restriction of processing concerning you as the data subject or to
object to processing as well as the right to data portability;
(c) you have the right to withdraw your consent at any time to the processing of your
personal data, without affecting the lawfulness of processing based on your consent
before its withdrawal;

(d) you have the right to lodge a complaint with a supervisory authority;
(e) the provision of your personal data is a statutory and a contractual requirement
in this letter and a requirement necessary for you to enter your contract
with me, and you are obliged to provide the personal data to me and you agree that
if you fail to provide me with such data I will be unable to provide you with legal services
and to act for you in this matter
